Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and the individual who operates UmaTracker ("we", "us", the "Operator"). They govern your use of the website at https://umatracker.com and any related services (together, the "Service").

By accessing or using the Service you agree to these Terms and to our Privacy Policy, which explains how we handle your data. If you do not agree, do not use the Service.

UmaTracker is a free, non-commercial, fan-made companion tool for the mobile and PC game Uma Musume Pretty Derby. It lets you browse game data, track the characters and support cards you own, plan gacha pulls and carat spending, build Champions Meeting teams, and share those plans with others.

The Service is provided free of charge. There are no paid tiers, subscriptions, advertisements or in-app purchases. We may accept voluntary donations, which are not payment for any service and do not create any entitlement.

You must be at least 16 years old to create an account or otherwise use the Service. By using it you confirm that you meet this requirement and that you are able to enter into a binding agreement under the laws of your country.

Some features work without an account. To save data across devices you sign in with a Google account through Firebase Authentication. You may also be given an anonymous account automatically so that planner data persists in your browser before you sign in.

• You are responsible for keeping your Google account secure. Anyone who can sign in to it can access your UmaTracker data.
• You may hold only one UmaTracker account per Google account, and you may not use someone else's account without their permission.
• Tell us promptly at sandwave+umatracker@gmail.com if you believe your account has been accessed without authorisation.
• You can delete your account and all associated data at any time from the Account page. See section 9.

Use the Service only for its intended purpose and in a way that is lawful and fair to others. In particular you agree not to:

• Access, or attempt to access, data belonging to other users, or interfere with the security or authentication of the Service.
• Send automated requests, scrape, crawl or bulk-download content beyond what a normal person browsing the site would generate. The Service applies rate limits and may block traffic that exceeds them.
• Circumvent, disable or probe rate limiting, access controls or other protective measures.
• Upload or share content that is illegal, infringing, defamatory, hateful, or that contains malware or harmful code.
• Use the Service to impersonate any person or to misrepresent your affiliation with anyone, including the Operator or Cygames.
• Resell, rent or commercially exploit the Service or its data without our written permission.
• Reverse engineer or decompile the Service, except to the extent that applicable law expressly permits it.

We may suspend or terminate access for accounts or IP addresses that we reasonably believe are violating these rules, with or without notice.

The inventory, plans, settings and other information you enter ("Your Content") remain yours. We claim no ownership over it. You grant us only the limited licence needed to store, process, back up and display Your Content to you, and to the people you choose to share it with, for the purpose of operating the Service.

• Each account may hold up to 20 shared plans. Re-sharing the same plan updates its existing link.
• Shared plans are snapshots: later edits to the original plan are not reflected until you share it again.
• All of your shared plans are removed when you delete your account. To remove an individual shared plan sooner, contact us.
• You are responsible for Your Content. Do not enter anything you do not have the right to share.

Character, support card, skill, banner and schedule data shown on the Service is compiled from community resources, primarily GameTora and uma.moe, with manual corrections by the Operator. These sources are not affiliated with UmaTracker and we are grateful for their work.

Nothing on the Service is guaranteed to be accurate, complete or current. In particular:

• Global-server release dates are estimates derived from the Japanese schedule and may be wrong by days or weeks. Cygames decides the real schedule.
• Pull odds, pity mechanics, carat projections and team or deck recommendations are mathematical models and heuristics. They are not advice, and real outcomes will differ.
• Game data may be outdated after a game update until our next sync.

Any decision you make about spending time, in-game currency or real money is entirely your own. Gacha involves chance; please spend responsibly.

Uma Musume Pretty Derby and all related characters, names, artwork, logos and other assets are trademarks and copyrights of Cygames, Inc. UmaTracker is an unofficial fan project. It is not affiliated with, endorsed by, sponsored by or otherwise connected to Cygames, Inc., CyDesign, Inc., or any of their partners. Game assets are displayed for the purpose of identifying in-game items and belong to their respective owners. If you are a rights holder and believe content on the Service should be removed, contact us and we will act promptly.

The UmaTracker name, the design of the site, and the original code, text and tooling that make up the Service belong to the Operator. You may not copy or redistribute them except as allowed by law or by any open-source licence the Operator publishes.

By you. You may stop using the Service at any time. To remove your data, go to the Account page and choose Delete account. This immediately and permanently deletes your profile, all of your saved data and all of your shared plans, and removes your authentication record. It cannot be undone. You can download a copy of your data from the same page first.

By us. We may suspend or delete accounts that breach these Terms, that we are required to remove by law, or that belong to a service or feature we discontinue. Where reasonable we will try to give notice in advance. We may also delete anonymous accounts that have been inactive for a long period.

Sections 6 (as to content already shared and since removed), 8, 10, 11 and 13 survive termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY OR NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT DATA WILL NOT BE LOST, OR THAT ANY ESTIMATE, PROJECTION OR RECOMMENDATION WILL BE CORRECT.

This is a hobby project maintained in one person's spare time. It may change, break, or shut down at any time. Please keep your own records of anything important.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, IN-GAME CURRENCY, GAME PROGRESS, PROFITS OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE SERVICE IS FREE, THE OPERATOR'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED TEN EUROS (€10).

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer-protection rules in your country of residence. If you are a consumer in the European Union, you keep all rights granted to you by the law of your country.

We may add, change or remove features at any time. We may also update these Terms. When we make material changes we will update the "Last updated" date at the top of this page and, where the change is significant, show a notice in the app. Your continued use of the Service after the changes take effect means you accept the revised Terms. If you do not accept them, stop using the Service and delete your account.

These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally shall be brought before the courts of Portugal, except that if you are a consumer resident in the European Union you may also bring proceedings in the courts of your own country of residence, and you retain the protection of that country's mandatory consumer laws. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it.
